The Petitioner's School is functioning under Central Board of Secondary Education system.
2.On 17.11.2014, the Provisional Affiliation has been granted to the petitioner/School by the Central Board of Secondary Education, subject to the condition that the petitioner has to get "No objection" from the second respondent viz., the Director of Matriculation Schools.
3.While granting the Provisional Affiliation, a condition has been imposed by the first respondent stating that in case of any objection by the second respondent, the provisional affiliation shall be suo motu withdrawn. Aggrieved over the condition, the Petitioner has come before this Court by way of Writ under Article 226 of the Constitution of India. 4.Heard Mr.M.Venkatachalapathy, Learned Senior Counsel appearing for the petitioner, Mr.G.Nagarajan, Learned counsel appearing for the first respondent and Mr.V.Anandhamoorthy, Learned Additional Government Pleader appearing on behalf of the second respondent.
5.When the matter is called today, learned Senior Counsel appearing for the petitioner would produce a copy of the "No Objection" letter given by the second respondent/Director of Matriculation Schools as well as the Certificate of Recognition, dated 23.08.2017.
6.In view of the grant of Certificate of Recognition as well as No Objection, the question of going into the issues raised by the petitioner/School does not arise at all and therefore, the first respondent is directed to pass appropriate orders on production of Certificate of Recognition as well as No Objection Certificate granted by the second respondent/Director of Matriculation Schools.
7.In fine, the writ petition stands disposed of with a direction to the first respondent to pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petitions are closed.
