The petitioner, who apprehends arrest at the hands of the respondent Police for the offences under Section 305(a) of BNS, in Crime No.30 of 2025, on the file of the respondent, seeks anticipatory bail. 1/4

2. The case of the prosecution is that the accused had committed theft of 5 sovereigns of thali chain. Hence the case.

3. The contention of the learned counsel appearing for the petitioner is that the petitioner is innocent and was falsely implicated in this case. He further submitted that the petitioner is a Painter and due to the dispute between the petitioner and his contractor, a false complaint has been lodged against the petitioner. He also submitted that the petitioner was involved in the painting work at the de facto complainant's house on 19.11.2024, whereas, the complaint was lodged only on 14.03.2025. Hence, he prayed for grant of anticipatory bail.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed for granting anticipatory bail to the petitioner.

Considering the submissions made by the learned counsel appearing on either side and taking note of the nature of the allegations, this Court is of the view that the custodial interrogation of the petitioner is necessary in this case, therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
