Order The Court made the following order :- The petitioner is the Accused in Crime No. 648 of 2026 of Arni Inspector of Police,Arni Town Police, who was arrested and remanded to judicial custody on
11.03.2026 for the offences under Sections 318(2) and 337 of BNS, seeks bail. 2.The case of the prosecution is that the petitioner who is a senior bailiff at Polur Sub court, has fabricated an attachment raising order of the court by forging the signature of the Authenticating Officer. Hence the case.
3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he has been arrested and he is languishing in jail from 01.03.2026 and he is ready to abide by any stringent conditions that may be imposed by this Court. Therefore, he prays for grant of bail.
4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case. He further submitted that the earlier bail application filed by the petitioner got dismissed by this Court. Hence, he opposed to grant bail to the petitioner.
5. Though the earlier bail application was dismissed the learned counsel for the petitioner submitted that he allegation mainly relates to misuse of the court seal and that the petitioner has been incarceration for more than 60 days. It
was also submitted that stringent departmental proceedings have already been initiated against him and considering the period of incarceration, and the injured person discharged from hospital, this Court is inclined to grant bail to the petitioner on certain conditions.

Accordingly, the petitioner shall pay a sum of Rs. 1,00,000/- (Rupees One Lakh only) as cost to the District Legal Services Authority, Thiruvannamalai District and on such payment, the petitioner is ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Principal District and Sessions Judge, Tiruvannamalai, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), each with two sureties, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: a)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; b)the petitioner shall report before the respondent police daily, twice at 10.30 a.m., and 4.30 pm for two weeks and thereafter, as and when required for interrogation, until further orders;
c)the petitioner shall not tamper with evidence or witness; d)the petitioner shall not abscond during trial; e)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
f) If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
