2. This is the Appeal preferred by the appellant/plaintiff against the judgment and decree dated 12.02.2014 in A.S.No.92 of 2013 passed by the learned Principal District Judge, Erode modifying the judgment and decree dated 07.02.2013 in O.S.No.81 of 2009 passed by the learned Subordinate Judge of Perundurai.

3. The Second Appeal is admitted on the following question of law:

Whether the first appellate Court erred in law in proceeding on PW1's admission that Item No.1 has co-sharers while ignoring DW1's contrary evidence that there is no co-sharer in item No.1.

4. Notice to the respondents through Court as well as privately, returnable in two weeks.

5. Post the matter after two weeks under the caption for 'final hearing'.
