ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.11.2021 for the alleged offences under Sections 8(c) r/w 20(b)(ii)(c), 29(1), 25 of NDPS Act, in Crime No.50 of 2021 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 29.11.2021, the petitioner, along with other accused persons, was found in possession of 140 packets containing approximately 279.900 kilograms of ganja.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the case and was not travelling in the vehicle at the time of occurrence. It is further submitted that the petitioner has been in judicial custody for a long period and is suffering from health issues. The learned counsel would submit that the petitioner has been taking treatment in the jail hospital. A discharge summary has also been produced before this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the case involves huge recovery of ganja and the trial is at an advanced stage. It is further submitted that the examination of Investigating Officer is posted on 11.06.2026. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submission of the learned counsel on either side, this Court is of the view that the petitioner seeks bail mainly on medical grounds. Though a discharge summary has been filed before this Court, no material has been placed to substantiate his immediate admission in a private hospital. Further, considering the case involves recovery of huge quantity of ganja and the trial is already at an advanced stage and the absence of sufficient medical grounds, this Court does not find any reason to enlarge the petitioner on bail.
