PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to give the pension revision benefits as per the 7th Central Pay Commission with effect from 01.01.2016 based upon the recommendation letter dated 27.05.2022 issued by the 8th respondent within a time limit fixed by this Court. ORDER

Heard Mr.Arun Anbumani, learned counsel for the petitioner and 2/6

Mr.A.R.Sakthivel, learned Senior Panel Counsel for respondents 1, 3 to 7 and Mr.C.K.Chandrasekar, learned counsel for 2nd respondent.

2. The petitioner herein had given representations to the respondents on 24.06.2022, 27.06.2022 and 01.07.2022, seeking revision of pension benefits on IDA scale of pay as per the 7th Central Pay Commission w.e.f 01.01.2016, based on the recommendation letter issued by the 8th respondent dated 27.05.2022. Since the said representations were not considered, the present writ petition has been filed.

It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, nonconsideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of the India and direct them to consider the same within a stipulated time.

4. In the light of the above observations, there shall be a direction to 3/6

the respondents herein to consider the petitioner's representations dated 24.06.2022, 27.06.2022 and 01.07.2022, on its own merits and pass appropriate orders in accordance with law, in the light of the recommendation of the 8th respondent dated 27.05.2022 within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any of its views with regard to the merits of the claim made by the petitioner and that it is open to the concerned respondent to consider the same on its own merits.

5. With the above direction, the Writ Petition stands disposed of. No costs.
