Respondents Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for records of the first respondent, relating to G.O.Ms.No.42, Transport Department, dated 27.05.2005, and to quash the condition in para No.5(a) that daily wages period shall be excluded while arriving not qualifying service and the condition in para No.5(b) that the Transport Department Employees, who retired after 01.09.1998 are not eligible for the second pension as per third G.O.(G.O.1028 Transport, dated 23.09.1985 and consequently, to direct the respondents to take action to grant pension to the petitioners to pay it from 01.01.1988.
