Mr.A.Gopinath Government Advocate (Criminal Side) PRAYER: Criminal Original Petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, pleased to enlarge the petitioner on bail in the event of his arrest by the respondent police in Crime No.44 of 2025 pending investigation on the file of the respondent police.
ORDER
The petitioner, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 69 and 351(3) of BNS Act, in Crime No.44 of 2025, on the file of the respondent Police, seeks anticipatory bail. 1 / 4
2. The case of the prosecution is that the 1st petitioner is alleged to have had physical relationship with the defacto complainant by making false promise that he will marry her and later refused to marry the defacto complainant. On questioning the same, the petitioners 2 and 3 joined with the 1st petitioner and threatened her. Hence, the case.
3. The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioners 2 and 3 have threatened the defacto complainant when she gave a complaint and that the 1st petitioner refused to marry her after having physical relationship with her. Therefore, he vehemently opposed to grant anticipatory bail to the petitioners.
5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners 2 and 3 with certain conditions.
6. Accordingly, the petitioners 2 and 3 are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial 2 / 4
Magistrate, Kalasapakkam, Thiruvannamalai District, on condition that the petitioners shall execute a separate bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further conditions that: (a) the petitioners 2 and 3 shall report before the respondent police everyday at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation;
(b) taking note of the grave offence committed by the 1st petitioner, the petition is dismissed in respect of the 1st petitioner ; [c] the petitioners 2 and 3 shall not tamper with evidence or witness either during investigation or trial.
[d] the petitioners 2 and 3 shall not abscond either during investigation or trial.

petitioners 2 and 3 in accordance with law as if the conditions have been imposed and the petitioners 2 and 3 released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.2023.
