This petition has been filed to condone the delay of 45 days in filing the above second appeal in SA.(SR).No.75578 of 2022 as against the Judgment and Decree dated 18.01.2021 made in A.S.No.3 of 2016 on the file of Subordinate Judge, Harur, Dharmapuri District confirming the Judgment and Decree dated 22.12.2015 made in O.S.No.25 of 2012 on the file of District Munsif Cum Judicial Magistrate Court, Pappireddipatti, Dharmapuri District.

2. Considering the facts and circumstances of the case, this petition is ordered subject to following condition:

"the appellant is directed to pay a sum of Rs.1000/- (Rupees One Thousand only) as cost directly to the respondent, within a period of one week from today, failing which, this petition shall stand automatically dismissed.

3. On such payment, Registry is directed to number the second appeal, if it is otherwise in order.

4. Print the name of Mr.M.Jothikumar, the learned counsel for the respondent, while listing the matter for admission.
