PRAYER: Writ Petition filed under Article 226 of Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, to call for the entire records relating to impugned Notice Inviting Tender floated by the 3rd respondent vide Roc.No.5120/2024/A4 DIRP/2269/Tender/2025 dated 14.05.2025 and the impugned Tender Cancellation Corrigendum dated 12.05.2025 published by the 3rd respondent, cancelling the earlier tender floated vide Roc.No.5120/2024/A4 DIRP/390/Tender/2025 dated 28.01.2025, and the impugned e-mail communication dated 14.05.2025 sent by the 3rd respondent to the petitioner intimating cancellation of the tender and Quash the same with consequential direction directing the 3rd respondent to evaluate the technical bid of the petitioner and other bidders and proceed with further process in the earlier tender floated vide Roc.No.5120/2024/A4 DIRP/390/Tender/2025 dated 28.01.2025. ORDER
The grievance of the petitioner is that, after the financial bid of the petitioner was opened, the tender was cancelled and the 3rd respondent is attempting to proceed further with the re-tender.
2. Mr.J.Ravindran, learned Additional Advocate General leading Mr.S.Prabakaran states that, the financial bid quoted by the petitioner on 19.02.2025 was not opened. He further states that the rates quoted by the co-tenderers have not been disclosed and continued to remain in the sealed cover. Hence, the plea of the petitioner that after a bid is opened, and on coming to know of the rates, the tender was cancelled does not hold water.
3. Hence, the Writ Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
4. At this stage, Mr.Srinath Sridaran, learned Senior Counsel representing Mr.M.Prem Kumar states that the last date for the re-tender is today. As the petitioner was challenging the re-tender, he has not 3/6
participated in the fresh process that has been initiated under the impugned proceedings.
5. Mr.Ravindran, learned Additional Advocate General states that the second respondent is willing to stretch himself and receive the tender documents from the writ petitioner for the fresh tender call on 26.05.2025 till 3.00 p.m. He assures that in case, the tender is filed and the documents are in order, the tender documents will be processed, if applied, within the aforesaid concessional time.
