Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus to direct respondents 3 to 11 to conduct an enquiry into illegal mining of ''sand'' and ''savudu'' in Survey No.352/1 at Thirukkandalam Village (called Isa Eri) as well as on the public lands (Grazing Promboke) in Survey No.337, 338, 339, 340, 341 to 349 and near the check dam being constructed in Kosathalai river and take criminal action against the mafia that has indulged in illegal mining and submit a status report to this Court within a time frame as may be fixed by this Court and further direct 4th respondent to submit a report as regards fine imposed for illegal mining from 2007 and amounts of recovery made thereon. (Order of the Court was made by The Hon'ble Chief Justice) Learned counsel for the petitioner states that the only relief he seeks is a direction for restoration of the lake. That is not the prayer made in the present petition. No representation in this behalf has also been made.
2.In view of the aforesaid, learned counsel for the petitioner seeks to withdraw the petition, with liberty to approach the authorities and failing their action, to approach this Court. An endorsement has been made.
