The petitioner has filed this writ petition seeking direction to the first respondent to settle the pensionary benefits due to her.
2.The case of the petitioner is that her husband worked as Village Administrative Assistant in Melpodavoor Village and he died on 18.01.2010 while he was in service, however, the pensionary benefits on the death of her husband, were not settled to her. In this regard, the petitioner gave representation on 12.04.2011 to the respondents 1 and 2. 3.Heard both sides and perused the materials available on record.
4.Considering the facts and circumstances of the case, more particularly the fact that the benefit payable to the petitioner is a valuable right of her husband and the same is no more considered to be a bounty to be handed out by the respondents at their whims, this Court directs the respondent authorities to consider the representation of the petitioner, dated 12.04.2011 relating to settlement of pensionary benefits, if not already considered, and pass appropriate orders, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
