ORDER

This petition has been filed seeking to direct the 3rd respondent not to release the retirement amount of the petitioner's father namely K. Subramanian S/o. Mr.Kandasamy working as Additional Treasury Officer, Kallakurichi after conducting enquiry based on the petitioner's representations dated 10.12.2024 and 10.01.2025.

2. Heard both sides.

3. The first petitioner is the son and the second petitioner is the wife of the fourth respondent / K. Subramanian. The learned counsel for the fourth respondent submits that after the divorce, the fourth respondent got married with another woman and got one daughter. He also submits that the 2/5

second petitioner is working as a Physical Education Teacher, however, the first petitioner has been brought up by the second petitioner. She has not been paid with any maintenance. As a father, R4 not look after his son / 1st petitioner. Now, the first petitioner is aged about 25 years. All these years, the mother alone has brought up the 1st petitioner. At the verge of the retirement of the fourth respondent, the petitioners have given representations to the third respondent on 10.12.2024 and 10.01.2025 not to release his retirement amounts.

Considering the facts and circumstances of this case, this Court directs the 2nd and 3rd respondent to disburse the retirement benefits by retaining a sum of Rs.3,00,000/- and the same is directed to be paid to the first petitioner after the retirement of the fourth respondent either directly through the bank account of the first petitioner or through a demand draft.

4. With the aforesaid directions, this writ petition is disposed of. No Costs.
