Respondents Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the proceedings bearing Na.Ka.No.377419/B7/2017 dated 3.1.2018 issued by the second respondent and quash the same and further direct the respondents to grant permission as theory examination center for Class X within a time frame.

ORDER

The petitioner has come up with this writ petition challenging the order dated 03.01.2018 passed by the second respondent and consequentially, seeking a direction to the respondents to grant permission as theory examination centre for class X within a time frame.

2.It is the case of the petitioner that though they have fulfilled all the requirements, in spite of the recommendations of the respondents 3 and 4, the application seeking the petitioner school as theory examination centre for class X examination during the academic year 2017-2018, has been rejected by the second respondent on the ground that the process of preparation for conducting the public examination has already commenced, which is arbitrary and unreasonable. Hence, this writ petition.

3.However, when the writ petition was taken up for hearing on 05.02.2018, the learned Special Government Pleader (Education) taking notice for the respondents, on instructions, submitted that the respondent authorities are going to pass order granting permission for examination centre to the petitioner. In view of the same, the matter was directed to be posted today i.e., on 06.02.2018 for production of the order to that effect.

4.Accordingly, when the matter is taken up for consideration today, the learned Special Government Pleader (Education) produced a copy of the proceedings dated 05.02.2018 bearing Na.Ka.No.134359/B8/2017 issued by the second respondent, wherein, the petitioner school has been made as the examination centre bearing Centre Code No.0330 for the ensuing public examination during the academic year 2017-18. 5.In the light of the subsequent proceedings passed by the second respondent as referred to above, this Court is of the view that since the prayer made by the petitioner has been meted out, nothing survives for adjudication in this writ petition. Hence, recording the same, this writ petition is closed. No costs. Consequently, connected Miscellaneous Petition is also closed.
