Petition filed under Article 226 of the Constitution of India for the issuance of writ of Declaration, declaring that the denial of employment to the petitioner is illegal, consequently direct the respondent to reinstate the petitioner in his service as a Salesman in the TASMAC shop with continuity of service, Back Wages, and all other attendant benefits.

O R D E R

The petitioner was initially engaged as Bar Attender by Tamil Nadu State Marketing Corporation Ltd., (hereinafter referred to as TASMAC) in 2007. The engagement was made in respect of Shop No.302. The TASMAC bar attached to Shop No.302 was later handed over to a private person resulting in disengagement of the petitioner. The petitioner submitted a representation to the respondent, requesting to provide him employment taking into account his earlier service. However, there was no follow up action taken by the respondent, resulting in filing this writ petition.

2. The first respondent is directed to consider and dispose of the representation submitted by the petitioner dated 05.11.2014 on merits and as per law. Such exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.

3. The petitioner is directed to forward a copy of the representation dated 05.11.2014 along with a copy of this order so as enable the respondent to consider the matter as expeditiously as possible.

4. The writ petition is disposed of with the above direction. No costs.
