Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus to direct the 1st Respondent to dispose the representation dated 05.08.2024 pending on the file of the 1st respondent in accordance with law.

ORDER

(Made by G.R. SWAMINATHAN, J.) Heard learned counsel for the petitioner and the learned Additional Government Pleader for respondents 1 and 3. Issuance of notice to respondent No.4 is dispensed with.

2. The petitioner has given a representation on 5.8.2024 alleging that respondent No.4 had committed encroachment on public pathway/pond. Since action was not initiated, the present writ petition came to be filed.

3. When the matter was taken up, learned Government Advocate submitted that the enquiry is proposed to be held on 4.6.2025 and notice has already been issued to respondent No.4.

4. We direct respondent No.2 to conclude the enquiry on merits within a period of two months thereafter. If the encroachment is confirmed, the same shall be removed by adhering to due process of law.

5. The writ petition is disposed of accordingly. There shall be no order as to costs.
