Defendants Prayer : Civil Suit has been filed under Order VII Rule 1 CPC and Order IV Rule 1 of Original Side Rules of High Court praying for judgement and decree as follows:- a) declaring the suspension notice dated 15.10.2011 issued by the first defendant to the plaintiff as null and void. b) grant a permanent injunction restraining the first defendant from collecting extravagant and exorbitant service charges in the cards game, c) grant mandatory injunction directing the second defendant to initiate appropriate action against the first defendant club and to prevent

them from collecting extravagant and exorbitant service charges in the cards section alone.

d) to direct the first defendant to pay costs of this suit. For the plaintiff : Mr.V.Manisekaran

JUDGMENT

Counsel for the plaintiff is present.

2. It is represented by the learned counsel appearing for the plaintiff that the suit is settled out of Court and accordingly, seeks permission to withdraw the suit.

3. An endorsement has also been made by the learned counsel for the plaintiff in the plaint to that effect.

4. In the light of the above position, the Civil Suit is dismissed as settled out of Court.

5. Registry is directed to refund half of Court fee, if rules permit. Consequently connected applications are closed. No costs. 15.06.2017
