PRAYER:

Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 1st Respondent to provide adequate police protection to the petitioners family member to safeguard.

ORDER

This petition has been filed seeking for police protection. 2.It is seen from records that there is a pathway dispute between the petitioner and the 3rd respondent and a complaint was also given by the petitioner against the 3rd respondent in this regard and an enquiry was also conducted by the Superintendent of Police, Land Grabbing Cell, Nagapattinam.

3.Even thereafter in the year 2018, a compliant was given before the 2nd respondent police and the same was taken on file in C.S.R.No.119 of 2018. Again the present complaint has been given on 23.04.2019 before the 2nd respondent. Since, no action has been taken on the 2nd respondent, the present petition has https://hcservices.ecourts.gov.in/hcservices/

been filed before this Court.

4.Heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent police.

5.Taking into consideration the facts and circumstances of the case, there shall be a direction to the 2nd respondent to call the parties and conduct an enquiry. If the 2nd respondent police finds the dispute in this care is civil in nature, he shall relegate the parties to approach the Competent Civil Court to enable them to workout their remedies.

6.This Criminal Original Petition is disposed of with the above directions.
