Respondents PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to immediately implement the Mayiladuthurai Bypass Road Project along with the construction of the Road Over Bridge (ROB) at the Mappadugai Railway Gate in accordance with G.O. (MS) No. 86 Highways & Minor Ports (HP1) Department, dated 04.10.2021 to resolve all pending land acquisition issues expeditiously through joint and proactive measure by the Departments ensuring fair compensation and rehabilitation to the affected parties to take all necessary steps to alleviate current traffic congestion and risks at the Mappadugai Railway Gate and ensure the safety and convenience of the travelling public; to complete the entire project within a stipulated time frame
under continuous monitoring and with full transparency in implementation.

Mr.V.Chandrasekaran for respondent No.1 Mr.A.Edwin Prabakar State Government Pleader assisted by Mr.M.Habeeb Rahman Government Advocate for respondent Nos.2 to 6 COMMON ORDER (Order of the Court was made by the Hon'ble Chief Justice) The writ petition is filed seeking appropriate direction to the respondents to speed up Mayiladuthurai bypass road project along with the construction of road over bridge at Mappadugai railway gate as per G.O.(Ms) No.86, dated 4.10.2021 and also to resolve all pending land acquisition issues through joint and proactive measures.
2. The contents of the reply-affidavit filed by respondent No.2 show that the land acquisition proceedings are pending since quite some time for one or the other reason.
3. Application (W.M.P.No.25444 of 2025) seeking impleadment has been filed by one Shri A.Rajendran, which shows that he has filed a writ petition challenging the notice in the matter of land acquisition proceedings.
4. Be that as it may, since the land acquisition proceedings have not been concluded so far, respondent authorities shall make all endeavours to conclude the land acquisition proceedings as early as possible.
We would not express any opinion on the merits of the pending writ petition filed by the proposed respondent. We, however, are of the view that the issue of legality or validity of the land acquisition proceedings raised at the instance of the proposed respondent are completely outside the scope of the present public interest litigation. For that reason, we are not inclined to allow the application (W.M.P.No.25444 of 2025) and it is rejected with liberty to pursue the pending writ petition.
5. In our view, as the land acquisition proceedings have not been concluded so far, the only direction which can be issued is to
complete the land acquisition proceedings as early as possible without any unnecessary delay.
6. With the above observation, at this stage, the writ petition is disposed of. There shall be no order as to costs. Consequently, W.M.P.Nos.21167 to 21169 of 2025 are closed.
