This petition has been filed to dispense with the production of the certified copy of the impugned surcharge order proceedings issued by the Deputy Registrar of Cooperative Societies under Section 87 (1) of the Tamil Nadu Cooperative Society Act in Na.Ka.No.1244/2008/E dated 27.09.2012.

2. Heard Mr.R.Krisnamoorthy, learned counsel appearing on behalf of the petitioner, who would submit that, that such order was impugned in the statutory appeal filed before the learned Principle District Judge/Tribunal for Cooperative Cases at Salem, in CMACS.No.13 of 2012, where, the CMA was decided against the revision petitioner. Therefore, against the said dismissal of CMA only the main revision has been filed. Hence, the order dated 27.09.2019, that is the surcharge proceedings issued by the original authority has got merged with the said CMA order. Therefore, the certified copy of the same could not be produced by the petitioner, however, photo copy is filed before this Court.

3. Considering the aforesaid situation, this Court is inclined to allow this petition. Accordingly, this petition is allowed. 25.09.2019 dua http://www.judis.nic.in
