Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for the issuance of writ of Mandamus to direct the respondents 1 to 5 to consider the representations of the petitioner dated 09.02.2015 remove the illegal encroachment and illegal construction made by the respondents 6 and 7 consequently direct the respondents 1 to 5 to construct water tank on the property situated at Kanchipuram District, Sholinganallur Taluk, Injambakkam village in Survey No.282/2 of an extent of 5500 Sq.Ft.

O R D E R

(Order of the Court was made by M.M.SUNDRESH,J.) This probono publico is filed seeking consideration of the representation made by the petitioner on 9.2.2015 to the official respondents, wherein it is alleged that the respondents 6 and 7 are unauthorisedly putting up construction in the property belonging to the 3rd respondent. Inspite of the representation made by the petitioner, the 3rd respondent has not taken any action. Hence, the present writ petition is filed.

2. Heard the learned counsel appearing on either side.

3. Taking note of the pendency of the representation dated 9.2.2015 made by the petitioner, without going into the merits of the case, a direction is hereby issued to the 3rd respondent to consider representation dated 9.2.2015 made by the petitioner and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of copy of this order, after affording an opportunity of hearing to the petitioner as well as the private respondents No. 6 and 7.

4. The writ petition is disposed of accordingly. However, there is no order as to costs. Consequently, the connected miscellaneous petition is closed.
