A.Nos.3542 & 4034 of 2022 in CS.DR.No.71125 of 2022 R.N.MANJULA, J In a proposed suit seeking for partition, the plaintiffs seeking leave to sue (i) the item nos.2 to 5 in the suit scheduled properties and (ii) against the defendant 1 in the plaint D.No.71125 of 2022 respectively.

2. The learned Counsel appearing for the applicant would submit that the the suit properties are partially situate within the jurisdiction of this Court and the items 2 to 5 are situated outside the jurisdiction of this Court.

3. Upon considering the above submissions and examining the draft plaint, the affidavit filed in support of this application and the fact that the cause of action for this suit has arisen at least partly within the jurisdiction of this Court, the applications in A.Nos.3542 & 4034 of 2022 are allowed by granting leave to the applicants to sue.
