Crl.MP.No.8519 of 2019 in Crl.RC.No.845 of 2012 P.VELMURUGAN.J, This Criminal Miscellaneous Petition has been filed to condone the delay of 386 days in filing the substitution petition.

2. The petitioner/ defacto complainant died on 13.12.2017, who is none other than the father of the deceased/victim. One of the daughter of the petitioner/sister of the deceased filed a petition for substitution in the place of the revision petitioner, for which, there is a delay of 386 days and hence, she filed this petition seeking to condone the delay.

3. The revision petitioner died on 13.12.2017 and the main accused A1 and A2 already died and A3 is the sister of A1/Sister-inlaw of the deceased, who is aged about 65 years.

4. In view of the above fact, this Court is not inclined to condone the delay of 386 days in filing the substitution petition. Accordingly, this Criminal Miscellaneous Petition shall stand dismissed.
