rpl examining PW.1, the counsel was engaged in other Court. Therefore, he was not able to cross examine the witness.

This Court finds that the said reason is untenable, more so, the witness is the victim and a minor girl aged 9 1⁄2 years. Hence, this Criminal Original Petition is dismissed.
