These petitions have been filed to modify the condition imposed on the petitioners by an order dated 09.06.2023 in Crl.O.P.Nos.12582 and 12584 of 2023 should deposit original title deeds of immovable property standing either in the name of the petitioners or his relatives/friends, worth about Rs.5,00,000/-, to the credit of Cr.No.15 of 2023 and on such deposit, the petitioners are ordered to be released on bail on their executing a separate bonds for a sum of Rs.10,000/- with two sureties, each for a like sum to the satisfaction of the Special Court under TNPID Act, 1997, Chennai.

Mr.Singaravelan, learned Senior Counsel appearing for the petitioners would submit that the petitioners are A3 and A5 in Cr.No.15 of 2023 registered by the respondent police for the offences under Sections 406, 420, 506(i), 120 of IPC and Sections 5 of TN Protection of Interest of Depositors (In Financial Establishment) Act, 1997. He would further submit that the petitioners were remanded to judicial custody on 20.05.2023 and this Court by an Order dated 09.06.2023 had granted bail to the petitioners in Crl.OP.Nos.12582 and 12584 of 2023 with a condition that each of the petitioners should deposit original title 1/4

deeds of immovable property standing either in the name of the petitioners or relatives/friends, worth about Rs.5,00,000/-, to the credit of Cr.No.15 of 2023. He would further submit that neither the petitioners nor their relatives own any property and thereby, the petitioners are unable to comply with the conditions. He also submit that despite the order being granted on 09.06.2023, they are still languishing in prison. He would submit that the co-accused were enlarged on bail. He would submit that the petitioners in the alternative are ready and willing to deposit Rs.25,000/- each to the credit of crime number and thereby, the present petition seeking modification may be allowed.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police would submit that it is a case where the petitioners along with other accused have cheated a sum of Rs.13,95,000/- . Hence, he would vehemently oppose to modifying the order.

5. Considering the submission made by the learned counsel appearing for the petitioners, the condition imposed as against the petitioners are modified to the effect that " each of the petitioners are directed to deposit Rs.25,000/- each 2/4

(Rupees Twenty Five Thousand only) to the credit of Cr.No.15 of 2023 without prejudice to their rights and contentions before the trial Court ...". The other conditions shall remain unaltered.

5.With the above directions, these Criminal Miscellaneous Petitions are ordered.
