This petition has been filed seeking to condone the delay of 42 days in filing the above appeal against the judgment and decree dated 13.11.2019 made in O.S.No.25 of 2018, on the file of learned Principal District Judge, Krishnagiri.

2. Mr.T.Chandrasekaran, learned Special Government Pleader appearing for appellant would submit that the copy of decree was obtained by the appellant on 24.01.2020 and thereafter, the District Government Pleader has opined to file appeal against the said decree. Thereafter, the grounds of appeal was preferred, however, there is a delay of 42 days and the delay is neither willful nor negligent. Hence, he has filed the present petition to condone the delay.

3. Mr.S.Vinod, learned counsel for respondent appeared and submitted that he has no objection in allowing this petition.

4. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition.
