PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent consider the representation of the petitioner herein dated 16.08.2013.

O R D E R

The relief sought for in the present writ petition is to direct the respondent to consider the representation of the petitioner dated 16.08.2013.

2. The learned counsel for the petitioner states that the petitioner submitted a representation to include the name of the petitioner in the Patta.

3. Grant of Patta, Mutation of Revenue documents or otherwise are to be made strictly by following the procedures as contemplated under the Patta Passbook Act, 1983. Under the Act, any person aggrieved, may submit an application to the competent authority for conducting an enquiry and for passing orders. Thus, High Court cannot issue a direction to consider the representation in the matter of Patta to be dealt with in accordance with law for the purpose of inclusion of the name of the petitioner in the Patta by following the procedures as contemplated under the Act.

4. This being the scope, the petitioner is at liberty to submit an application in the prescribed format before the competent authority under the provisions of the Act for the purpose of redressal of the grievances.

5. With this liberty, the writ petition stands disposed of. No costs.
