Respondents PRAYER: This Petition is filed under Article 226 of the Constitution of India, praying for the issue a Writ of Mandamus, directing the 3rd Respondent to consider the petitioner's representation letter dated 23.08.2021 to issue patta for the land in S.Nos.182/1, 182/3, 182/5 and 182/6 totalling to an extent of 50 cents and further direct the respondents not to dispossess the petitioner from the above land till the consideration of his representation letter dated 23.08.2021 and pass appropriate orders accordingly.

O R D E R

The relief sought for in this writ petition for issuance of Writ of Mandamus, directing the 3rd Respondent to consider the petitioner's representation letter dated 23.08.2021 to issue

patta for the land in S.Nos.182/1, 182/3, 182/5 and 182/6 totalling to an extent of 50 cents and further direct the respondents not to dispossess the petitioner from the above land till the consideration of his representation letter dated 23.08.2021 and pass appropriate orders accordingly.

2. Heard the learned counsel appearing for both sides as well as perused the material available on records.

Having considered the facts and circumstance of the case and submissions of the learned counsel on either side, it is seen that the petitioner and his ancestors are doing agricultural activities in the aforesaid lands for the past seven decades. The petitioner is paying the tax for his cultivating lands and he is in possession of the receipts for the period of 18.03.1984 and 17.03.1992. In the meanwhile, the petitioner has made representation dated 23.08.2021 to the 3rd respondent to issue Patta for the aforesaid land while the Government is about to acquire the same. The respondents have neither sent any reply nor passed any orders on his representation dated 23.08.2021 so far. Hence, this Court without expressing any opinion with regard to the merits of the case, directs the 3rd respondent to consider the representation dated 23.08.2021 made by the petitioner herein and pass appropriate orders within a period of eight weeks from the date of receipt of copy of this order in accordance with law after affording sufficient opportunity to the petitioner herein.

4. With the aforesaid directions, the Writ petition is disposed of. Consequently, connected miscellaneous petition is closed if any. No Costs.
