PRAKASH CRIMINAL MISCELLANEOUS PETITION No.8991 of 2019 in CRL.R.C.No.153 OF 2019 C.NALLATHAMBI [ PETITIONER ] Vs B.SUKUMAR [ RESPONDENT ] Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition of bail imposed on the petitioner in Crl.M.P.No.1351/2019 in Crl.R.C.No.153/2019 dated 29.01.2019 to direct the petitioner to report before the Trial Court on the first working day of every month 10.30 am pending disposal of the above Crl.R.C.No.153 of 2019.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.BHIMAN V., Advocate for the petitioner and of M/S P.V.SANJEEV, Advocate on behalf of the Respondent the court made the following order:- This Court has suspended the sentence and released the petitioner on bail on certain conditions, one of which is that the petitioner shall report before the trial Court on the first working day of every month. This petition has been filed for relaxing the said condition.

2.In the opinion of this Court, the said condition cannot be relaxed in toto and this petition stands dismissed. However, liberty is granted to the petitioner to file an application under Section 317 Cr.P.C., if the petitioner is not able to appear on any particular day and appear before the Magistrate on any other day as determined by the Magistrate in lieu of the day on which the petitioner is absent.
