This application has been filed seeking condonation of delay of 570 days in filing the written statement by the 5th defendant in the suit.

2. The suit is one for partition and separate possession of the plaintiff's share. It is averred in the affidavit filed in support of the application that the matter was referred to mediation and parties were awaiting the outcome of mediation. Since the mediation did not succeed, they realized that they should have filed the written statement much earlier. Accepting the said reasons, this application is allowed, the delay of 570 days in filing the written statement is condoned.
