No.200-3/ 2018 (Mineral) dated 08.03.2024 and to quash the same as illegal consequently to direct the respondents to relinquish the petitioner from the arbitrary demand based on the petitioners representation dated 10.05.2024 within a time period to be stipulated by this Honourable Court.

O R D E R
Mr.Stalin Abhimanyu, learned Additional Government Pleader accepts notice for the respondents and is fully armed with necessary instructions to enable a final disposal of this matter, even at the stage of admission.
2. The petitioner challenges notice dated 08.03.2024 issued by the Assistant Director, Geology and Mining Department, Vellore/R2 on the ground that the same is in violation of the principles of natural justice.
3. Some submissions are made on the merits of the matter which the Court is not inclined to advert to seeing as, as rightly contended by the respondents, the impugned notice only calls for the petitioner to appear before the officer and put forth his explanation in regard to the allegations contained therein.
4. Mr.Stalin assures the Court as well as the petitioner that a full opportunity will be given to the petitioner to put forth his explanation including an opportunity of personal hearing. This is recorded.
5. The matter is now stated to be listed before R2 on 18.07.2024. The petitioner will appear before R2 on that date as well as on any subsequent dates on which he will be called, put forth his submissions as well as file documents, if any.

6. R2 shall hear the petitioner, consider the documents, if any, filed by him and pass orders in accordance with law and all extant Rules and Regulations expeditiously.
