Petition filed under section 226 of the Constitution of India to issue a Writ of Mandamus directing the first respondent to conduct the Vinayagar Koil Festival will be conducted on 25.03.2015 at Thoppadikuppam Village in traditional manner with the participation of all willing persons without any discrimination. O R D E R
Heard Mr.R.Sreedharan, learned counsel appearing for the petitioner and Mr.S.Gunasekaran, learned Government Advocate appearing for the respondents 1 to 4. With the consent of both the parties, this writ petition is taken up for final disposal. 2.This writ petition has been filed by the petitioner, for the issuance of a Writ of Mandamus, directing the first respondent to conduct the Vinayagar Koil Festival scheduled to be conducted on 25.03.2015 at Thoppadikuppam Village in traditional manner with the participation of all willing persons without any discrimination. 3.According to the petitioner, the fifth respondent is preventing the petitioner and the local people from celebrating the Temple festival. The petitioner claims to be the Dharmakartha of the Temple and he has lodged complaint before the first respondent police stating that three persons namely, Perumal son of Govindasamy, Kalaivani wife of Arumugham and Krishnan son of Govindhan are objecting to the conduct of the festival.
4.Since a complaint is pending before the fourth respondent, there will be a direction to the fourth respondent to enquire into the complaint which has been taken on file as CSR No.531 of 2014 dated 13.12.2014, by directing the petitioner, Perumal son of Govindasamy, Kalaivani wife of Arumugham and Krishnan son of Govindhan to appear for enquiry and conduct a peace meeting in the presence of Revenue Official/ Village Administrative Officer and ensure that an amicable solution is arrived at and Temple festival is celebrated without any problem after hearing all the parties. The said peace meeting shall be convened by 5.00 p.m. on 24.03.2015 since the festival is scheduled to be conducted on 25.03.2015. 5.The writ petition is disposed of with the above observations. No costs. Consequently, the connected miscellaneous petitions are closed.
