By consent, the Writ Petition itself is taken up for final hearing.

2.This Writ Petition has been filed by the petitioner seeking a direction to the respondents to disburse him, the balance retirement benefits to the tune of Rs.1,86,911/- together with interest from 01.11.2008.

3.Heard the learned counsel for the petitioner as well as the learned Special Government Pleader appearing on behalf of the respondents.

4.The petitioner was appointed as Secretary in the second respondent Society on 01.08.1981 and retired from service on 31.10.2008. At the time of his retirement, the second respondent had deducted a sum of Rs.1,45,448/- from his retirement benefits and recovered Rs.41,463/- towards excess https://hcservices.ecourts.gov.in/hcservices/

payment that too without any notice. In view of the same, he filed revision petition before the first respondent but he returned the same and asked to make representation to the second respondent. Inspite of several representations made by the petitioner to return back the said deducted amount of Rs.1,86,911/- together with interest, there was no response. Hence, the petitioner has come forward with the present writ petition.

5.The learned Special Government Pleader for the respondents submitted that eligible amount has already been paid to the petitioner.

6.Considering the submissions made on either side, the second respondent is directed to consider the petitioner's representation dated 08.03.2016 and pass appropriate orders in accordance with law, within a period of three months from the date of receipt of a copy of the order.

7.With the above direction, this Writ Petition is disposed of. No costs.
