Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the second respondent to give promotion to the petitioner as Manager (marketing) as per panel dated 21.07.2008 or give up-gradation to the scale of pay of Rs.12,000-375-16500 (old scale) i.e.in the new scale of Rs.15600-39100 plus 7600 (Grade Pay) w.e.f 8.7.2011 when the panel dated 21.07.2008 was implemented.

ORDER

This writ petition has been filed seeking a mandamus directing the second respondent to give promotion to the petitioner as Manager (Marketing) as per panel dated 21.07.2008 or give up-gradation to the scale of pay from Rs.12,000-37516500 to Rs.15600-39100 + 7600 (Grade Pay) with effect from 08.07.2011, when the panel dated 21.07.2008 was implemented.

2. Today, when the matter was taken up for consideration, the learned counsel for the petitioner submitted that subsequent to the filing of this writ petition, the petitioner retired from service on reaching the age of superannuation, in the year 2017 and hence, the writ petition may be closed with liberty to the petitioner to approach the authority concerned for appropriate relief.

3.Granting such liberty to the petitioner, the writ petition stands closed. No costs. Consequently, the connected miscellaneous petition is also closed.
