[Order of the Court was made by S.NAGAMUTHU,J] The petitioner/Central Bureau of Investigation has come up with this petition seeking to condone the delay of 45 days in filing the appeal against acquittal rendered by the learned Principal District and Sessions Judge, Dharmapuri in S.C.No.247/2014. The Judgment of the trial Court was made on 18.12.2015.
2. In the affidavit filed in support of the petition, the Inspector of Police, CBI has explained as to how he acted from the day of Judgment until he filed appeal in getting the opinion approved from the higher officers etc.
3. In our considered view, since the delay is after all 45 days, condoning the same would not cause any prejudice to the accused.
4. Having regard to the same, even without notice, we are inclined to condone the delay. Delay is condoned.
5. Petition is ordered.
