JUDGMENT

The Suit is filed by the plaintiff for awarding a sum of Rs.1,50,00,000/- towards damages from the defendant for the defects made in the construction of Jain Nakshatra Apartments, in which the members of the plaintiff's Association are flat owners. 1/2 https://www.mhc.tn.gov.in/judis

vga 2.This matter was referred to Tamil Nadu Mediation and Conciliation Centre, High Court, Madras for Mediation. Mediation was completed and Mediation agreement is enclosed. 3.It is submitted by the learned counsel for the parties that as per the terms of the settlement agreed between the parties, the defendant agreed to rectify all the defects as per Annexure-A and therefore, the suit be dismissed as withdrawn. 4.It could be seen that in the Mediation, Final Settlement Agreement has been entered into between the parties. 5.Recording the above Final Settlement Agreement reached between the parties in the Mediation, the suit is dismissed as withdrawn. No costs. The final settlement agreement shall form part of the judgment.
