Writ Petition filed under Article 226 of the Constitution of India seeking for a direction to issue a Writ of Mandamus directing the third respondent to dispose of the petitioner's appeal filed against Order in SDRO/A/LA/NH-66/958/2010-2 dated 08.11.2012 pending on the file of the third respondent with considering National Highway Act 1956 within one month.

Heard Mr.K. Sudhakar and Mr.V. Subbiah, learned Special Government Pleader.

By consent of both sides, the main writ petition has been taken up for final hearing.

The petitioner has filed the above writ petition to issue a Writ of Mandamus directing the third respondent to dispose of the petitioner's appeal, filed against Order in SDRO/A/LA/NH-66/958/20102 dated 08.11.2012, pending on the file of the third respondent considering the National Highway Act 1956.

The learned Special Government Pleader, appearing for the third respondent, submitted that the third respondent may be directed to dispose of the appeal within a stipulated time. 3.

Taking into consideration of the limited prayer sought for in this writ petition, without expressing any opinion regarding the merits of the case, I direct the third respondent to dispose of the appeal, filed by the petitioner against the order in SDRO/A/LA/NH66/958/2010-2 dated 08.11.2012, on merits and in accordance with law, taking into consideration of the National Highway Act, 1956, within a period of twelve weeks from the date of receipt of copy of this order.

With the above observation, the writ petition is disposed of. No costs.
