Respondents Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus forbearing respondents 1 and 2 herein from in any way putting up constructions in the main passage leading from Northern side of Avanashi Road for building ADR (Alternative Dispute Redressal) Centre in the Coimbatore District Court Complex deviating from the original proposal of constructing ADR Centre in the vacant spaces available.

ORDER

(Order of the Court was made by M.M.SUNDRESH,J.) The grievance of the petitioner is that of the five entrances available to the District Court, Coimbatore, one is being blocked. It is only a temporary blockage meant to be in force till the completion of the construction. Hence, the petitioner cannot have a grievance over the same and the prayer sought for by the petitioner is not maintainable.

Suitability of a place is a matter which has to be decided by respondents 1 to 3. It appears that the place for constructing ADR Centre in the Coimbatore District Court Complex has been selected after considering the relevant materials. It is also seen that there is no objection from the fourth respondent as well. The petitioner cannot, as a matter of right, contend that the construction cannot be put up in a particular place. Therefore, looking from any angle, we do not find any reason to entertain this writ petition. However, we make it clear that as and when the construction is over, the temporary blockage will have to be removed. The writ petition stands disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
