This petition has been filed to enlarge the petitioner on bail in CC No. 334 of 2023 on the file of the learned principal Special Court under EC & NDPS Act cases, Chennai pending tria.

2. The case of the prosecution is that the respondent police found the accused persons while transporting 44 kgs of Ganja. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and also the alleged contraband was not recovered from this petitioner. Further, he has been in jail for the past 1 1/2 years. Hence, he prays to allow this petition.

4. The learned Government Advocate (Crl. side) submits that the accused persons jointly possessed the contraband which is commercial quantity and the petitioner has not engaged the counsel to conduct the trial. Hence, he raised objection to grant bail.

5. Considering the fact that total contraband seized from the accused persons is commercial quantity and also the petitioner is having one 302 IPC case. Hence, this Court is not inclined to allow this petition. Further, the petitioner is directed to conduct the trial by engaging the counsel before the Trial Court. Accordingly, this petition is dismissed. 19.07.2024 pbl
