The petitioner/accused, who was arrested and remanded to judicial custody on 22.04.2025, for the alleged offences punishable under Sections 8(c) read with Section 22(b)(ii)(B) of NDPS Act, in Crime No.46 of 2025, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner was found in possession of 6 kgs of ganja. Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would submit that the petitioner has been in judicial custody from 22.04.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate for the respondent reiterated the prosecution case and submitted that the petitioner is a habitual offender and that there are nine previous cases against the him, out of which, seven cases are similar in nature. Hence, he vehemently opposed for grant of bail to the 2/4
petitioner.
5. Heard both sides and perused the materials available on record including the First Information Report.
6. Considering the gravity of the offence and the bad antecedent of the petitioner, I am not inclined to grant bail to the petitioner herein. Hence, the Criminal Original Petition stands dismissed. 22.05.2025 Sma To 1.The Inspector of Police, PEW Washermanpet Unit, Chennai.
