Heard Mr.K.Krishnamoorthy, learned counsel appearing for the petitioner; Ms.R.Charulatha for M/s.Lakshmi Kumaran Associates for the first respondent and Mr.S.Kanmani Annamalai, learned Additional Government Pleader, appearing for the respondents 2 to 4.

2. This petition has been filed by Thiru.N.Vadivel, Assistant Commissioner, Valluvar Kottam Assessment Circle, to grant Leave to the petitioner to file the above petition in his capacity as a third party to expunge the observations made against the petitioner herein and the directions to the second respondent in the Writ Petition to take disciplinary action, may be recalled.

3. This petition is on account of the fact that this Court while disposing of the Writ Petition filed by the first respondent herein in W.P.No.14152 of 2016, has made certain observations against Thiru.N.Vadivel, Assistant Commissioner, Commercial Taxes and directed the Commissioner to take disciplinary action against the petitioner herein. Those observations having been made without notice to the petitioner, this Court is inclined to grant Leave to the petitioner to file the petition to expunge the observations, as a third party to the proceedings.
