Perambalur Crime No.49 of 2020 Respondent/Complainant PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to modify the condition viz., "(vi) that the petitioner shall deposit the original RC book in Court" imposed in Crl MP No.661 of 2020 by the learned Principal District and Sessions Judge, Perambalur.

ORDER

The Criminal Original Petition has been filed seeking for modification of the condition imposed by the Court below while allowing the application filed by the petitioner for return of vehicle.

2. The petitioner is aggrieved by Condition No.VI imposed by the Court below wherein, the petitioner has been directed to deposit the original RC book in the Court.

3. The learned counsel for the petitioner submitted that the original RC book has already been produced before the Court below, when an earlier order was passed for return of the very same vehicle in Crime No.642 of 2019. The learned counsel submitted that the petitioner must be permitted to file a memo to that effect before the Court below and seek for modification of the condition.

4. In view of the above submissions of the learned counsel for the petitioner, liberty is granted to the petitioner to file an appropriate petition / memo before the Court below and seek for modification of condition No.VI imposed by the Court below while passing orders in Crl.MP No.661 of 2020, dated 06.08.2020.
