ORDER

The petitioner/ accused No.4, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 304 of BNS Act in connection with Crime No.135 of 2026, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner, along with the other accused, robbed a sum of Rs.3,000/- from the de facto complainant.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent boy and, based on the confession statement of a co-accused, he has been falsely implicated in this case; that there is no recovery of any incriminating material from the petitioner; that the co-accused arrested in this case has been released on bail and that the petitioner has no previous case as against him. Hence prayed for anticipatory bail.

4. The Learned Government Advocate (Criminal Side) reiterated the prosecution case and would submit that there is no previous case pending as against the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the rival submissions on either side, the nature of offences charged against the petitioner, the co-accused has been released on bail and the fact that no previous case is pending against the petitioner, I am inclined to grant anticipatory bail to the petitioner subject to the following conditions.

7. [a] the petitioners and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [b] the petitioners shall report before the respondent police on every Saturday at 10.30 a.m., for a period of four weeks and thereafter as and when required for interrogation.

[c] the petitioners shall not tamper with evidence or witness either during investigation or trial.

[d] the petitioners shall not abscond either during investigation or trial. [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter abscond, a fresh FIR can be registered under Section 269 B.N.S.
