Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondents to consider the petitioner's representation 23.08.2016 and further representation dated 27.04.2021 and cancel the separate patta bearing No.3536 issued in favour of Mrs.Neelavathi with respect to the land comprised in 218B/8 as 218B/8B over an extent of 0.7.70 Ares in Vadalur Village, Chengalpattu Taluk, Kancheepuram District, now Chengalpattu District and restore the original joint patta bearing No.2761.

ORDER

The Writ Petition has been filed to direct the respondents to consider the petitioner's representation 23.08.2016 and further representation dated 27.04.2021 and cancel the separate patta bearing No.3536 issued in favour of Neelavathi with respect to the land comprised in 218B/8 as 218B/8B over an extent of 0.7.70 Ares in Vadalur Village, Chengalpattu Taluk, Kancheepuram District, now Chengalpattu District and restore the original joint patta bearing No.2761.

2. Heard Mr.M.Muthappan, learned counsel appearing for the petitioner, Mr.A.M.Ayyadurai, learned Government Advocate appearing for the respondents 1 to 3.

3. The petitioner submitted representations dated 23.08.2016 & 27.04.2021 before the second respondent to cancel the patta issued in favour of the respondents 4 to 6. On receipt of the same the second respondent called upon the third respondent to inspect the subject property and file report. However, it is pending without conducting any enquiry. Therefore, the petitioner filed this Writ Petition with the above prayer.

Considering the above facts, the second respondent is directed to consider the petitioner's representations dated 23.08.2016 & 27.04.2021, after issuance of notice to the petitioner as well as the respondents 4 to 6 herein, and after giving opportunity of hearing to both parties, pass orders on merits and in accordance with law, within a period of twelve weeks from the date of the receipt of a copy of this Order.

5. With the above directions, the Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
