This Original Petition has been filed taking advantage of the Section 372 of the Indian Succession Act, 1925, seeking succession certificate with respect to the securities of Mr.R.Srinivasan, who died intestate on 07.04.2021.
2. Mr.R.Srinivasan, was the husband of the first petitioner and father of the second and third petitioners. His parents Mr.K.Rengasamy & Mrs.Sarojini Ammal pre-deceased him on 03.02.1998 and 05.11.2011 respectively. After paper publication was effected, the petitioners were invited to adduce evidence.
3. The second petitioner, Mrs.Vidhyalakshmi Srinivasan examined herself as P.W.1. The death certificate and the legal heriship certificate of the deceased were marked as Ex.P1 & Ex.P2 respectively.
4. Considering the evidence adduced, this court is of the view that all the three petitioners are entitled to grant of succession certificate with power to collect the securities and to receive interest and dividends on and to negotiate and transfer the securities specified in the schedule to the petition. https://www.mhc.tn.gov.in/judis C.V.
