Heard Mr.V.Gunasekar, learned counsel appearing for the petitioner and Mr.R.A.S.Senthilvel, learned Additional Government Pleader appearing for the respondent. With the consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.
2.Petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondent to consider petitioner's application dated 14.07.2014 and 04.03.2015 to issue patta in favour of petitioner and petitioner's brother namely Thangabalu with regard to the land in Survey No.208/3, at Perumulai Post, Thittagudi Taluk, https://hcservices.ecourts.gov.in/hcservices/
Cuddalore District to the extent of 12 cents within the time fixed by this Hon'ble Court.
3.It appears that the petitioner's application was considered, enquiry was conducted and Village Administrative Officer has also submitted report to the Tahsildhar. The matter is now pending consideration before the Tahsildhar.
4.It is not known as to whether there is any rival claim for grant of patta. Hence, this Court is not inclined to grant any positive direction and it would suffice to direct the respondent to consider the petitioner's representation for grant of patta to the petitioner and his brother jointly, to the land in question, on merits after notice to the petitioner and his brother and any other person who is likely to be aggrieved, within a period of three months from the date of receipt of a copy of this order. 5.The writ petition is disposed of with the above observations. No costs.
