This miscellaneous petition has been preferred to suspend the conviction and sentence imposed on the petitioner in Spl.S.C.No.69 of 2020 dated 26.11.2021 on the file of the Special Court (POSCO Act Cases) Cuddalore pending disposal of the above Appeal. 2.When the matter is taken up for hearing there is no representation for the petitioner.
3.Heard the learned Additional Public Prosecutor for the respondent and perused the materials available on record.
4. It seems that since the petitioner was convicted for the offence under POSCO Act, this Court is not inclined to suspend the sentence imposed on him and hence, this Miscellaneous Petition is dismissed. On the other hand, this Court is inclined to take up the main appeal itself ''for final disposal'' soon after receipt of the entire records.
5. In the earlier occasion i.e on 10.08.2022 this Court directed the
Registry to call for the records from the Court below on or before 15.11.2022.
6.Since this Court is inclined take up the main appeal ''for final disposal'' earlier, the Registry is directed to call for the records from the Court below on or before 21.09.2022 and thereafter, prepare typed set of papers on or before 30.09.2022 and serve copies on the learned counsel on either side well in advance.
7.List the matter under the caption ''for final disposal'' on 13.10.2022.
