Alleging that without any jurisdiction both territorial and subject matter, the respondent police is unnecessarily harassing the petitioner 1/4

under the guise of investigation on the complaint given by one Raju and Kuppusamy.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the City Crime Branch of Coimbatore has received a complaint against this petitioner for cheating and in the course of investigation the petitioner was called. Without participating in the enquiry, the petitioner has approached this Court with false averments.

This Court, after perusing the representation given by this petitioner and the submissions made by the learned counsel for the petitioner, directed the respondent police to conduct investigation in the manner known to law and if the presence of the petitioner is required, he may be summoned for participating in the enquiry and production of documents if any. Without causing summons, the petitioner shall not be orally called to the police station for enquiry 4.

With this observation, this Criminal Original Petition is disposed of.
