O R D E R

The petitioner, who was arrested and remanded to judicial custody on 18.04.2025 for the offences under Sections 406, 420, 506(1), 120(B), 294(b) of IPC in Crime No.301 of 2024, on the file of the respondent Police, seeks bail. 1/4

2. The case of the prosecution is that the accused, who introduced themselves to the de facto complainant under the guise of a marriage proposal, cheated the de facto complainant to the tune of several lakhs of rupees. Hence the case.

3. The contention of the learned counsel appearing for the petitioner is that the petitioner, who has been arrayed as A3, is innocent and has been falsely implicated in this case. He further submitted that there were certain financial transactions between the petitioner and the de facto complainant and due to some misunderstanding, the said transactions have been camouflaged as a case of cheating. He also submitted that a group of Advocates is actively behind the de facto complainant and with an intent to extract money, has instigated the registration of a false case. In any event, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect.

4. Learned Government Advocate (Criminal Side) reiterated the prosecution case and objected for granting bail to the petitioner stating that the investigation is at final stage.

5. Learned counsel appearing for the intervener submitted that the petitioner is kept in dark and has not been informed about the progress of the investigation. She further submitted that the respondent Police have not taken any effective steps in this matter. Hence, she strongly objected for granting bail to the petitioner.

6. In view of the submissions and the endorsement made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn. However, the de facto complainant/Intervener is at liberty to appear before the Investigating Officer and make a representation for ensuring effective progress in the investigation.
