Respondent Prayer : Judges Summons filed under Order XIV Rule 8 of OS Rules read Section 12 of Guardians and Wards Act, 1890, to grant the applicant/petitioner to have the interim custody of the minor male child Nikhilesh born on 07.09.2022, aged about 3 years and 8 months, during Summer Vacation from 15th May, 2026 to 5th June, 2026 filed under the Guardians and Wards Act.

ORDER
This Court passed an order on 22.05.2026 in the following terms:- "9. Taking into consideration the aforesaid facts and circumstances, this court passes the following directions:
(i) Both the applicant and the respondent will go over to the aforesaid school, along with the child, at 9 am or some other time, that the school calls for an appearance of the parents of the child on 24.05.2026. (ii) After the interaction is over, the child will be with the father on 24.05.2026, 25.05.2026 and 26.05.2026.
(iii) During the time the child is with the father, the mother will be entitled to make phone calls/video calls to interact with the child. The applicant/father shall not obstruct the call so made and make the child communicate with the mother so as to give her the assurance as to how well the child is faring at his father's house.
(iv) Depending upon how the child is faring in the custody of the father, this court will decide about the further extension for 27.05.2026, 28.05.2026 and 29.05.2026."
2. The matter was listed today to find out how the child fared in the company of the father. Both sides represented that the child fell sick and hence, the aforesaid directions could not be implemented. Both sides agreed that the child has recovered from the sickness and is fit enough to be in the custody of the father.

3. Hence, this application is ordered. The father is permitted to take custody of the child tomorrow (i.e., on 28.05.2026) at 9.00 A.M. He shall have the custody of the child from 28.05.2026 till 31.05.2026. He shall drop the child back at the residence of the mother on 31.05.2026 at 8.00 P.M. Clause No.iii of the order, dated 22.05.2026 will apply during this period. The request for compensatory interim custody for having lost it on 16.05.2026 and 17.05.2026 can be considered by filing a separate application.
